Art

When artwork is submitted to The Legend Marketing Group for reproduction with an order, Legend trusts that the purchaser is submitting the artwork in full compliance with state and/or federal laws governing the use of copyrights, trademarks, signature marks, etc. The purchaser agrees to hold The Legend Marketing Group blameless for any damages, lawsuits, or any other unlawful acts resulting from the reproduction or use of said artwork.

1) Acceptance of artwork:
Computer-generated eps art should accompany your order. Charges will be applied to art that needs to be redrawn or touched-up. Approval is required prior to production.

2) To qualify as computer-ready artwork:
The following criteria must be met:
Artwork generated in one of the following software applications:
Illustrator CS2 (or earlier) saved as EPS
Freehand MX (or earlier) exported as EPS
Photoshop CS2 (or earlier) saved as EPS
Typestyles of submitted art must be converted to paths.

We can accept art on following types of media:
CD ROM disk or ZipTM disk. Please mark the mailing envelope "Magnetic Media Enclosed" to avoid damage in delivery.
Files may also be e-mailed (call for details).

Each file should contain:
a) converted type to a path or outline,
b) color version,
c) black and white version,
d) hard copy of the art in color. Please mark mailing envelope
"Magnetic Media Enclosed" to avoid damage in mail.

3) Additional Art Charges:
No art charges will be added for acceptable embroidery art designs. Please call for details on other identification methods.

4) Unserviceable Artwork:
Art in the following formats is not considered camera or digital ready.
Art requiring logo reconstruction to high resolution standards before use includes: black and white camera-ready art, fax transmissions, photocopies, blue book cuts, metallic labels, decals, patches, business cards, stationery and laser-printed artwork of less than 600 dots per inch. Electronic files not acceptable due to low print resolution include any web graphics or files with .gif, .doc, .exe, .pcx, .pub, .ppt, .p65 or .xls extensions. If sending unacceptable artwork, an art charge will apply.

5) Proof:
E-mailed electronic artwork or a paper proof of artwork will be returned for customer approval prior to production in 3 to 4 business days.

6) PMS Screen-print Color Match: $20.00(a) per color/logo.

7) Idea art: Mac sketches available $70.00 for first three; $10.00 for each additional sketch.

Embroidery Tape

FREE. No art and tape charges.

Acceptance of embroidery tape:
Legend will accept customer supplied tapes in Tajima(.dst, .T01), Melco(.cnd, .exp), Barudan(.dsb, .T03, .fmc, .fdr), Toyota(.100), Pfaff(.ksm, .T09), Wilcom(.emb, .esd, .inp), ZSK(.zsk, .T05), Zangs(.T04), Gunold (.pch, .stc), Datastitch(.stx), Proel(.pmu) and Compucon(.xxx) formats. If a customer tape must be edited for any reason, normal Legend tape charges will apply. Pre-production proof of customer supplied tape is required before processing orders.

Order Processing

1) Sales tax exemption certificates will be required prior to all sales order processing. All sales that occur before receipt of such documentation will be subject to state and local taxation. No tax credits will be issued on sales orders that occur before receiving said documentation.

3) Order Change/Cancellation:
All changes subject to $50.00(a) charge. No change or cancellation after production has begun. All expenses incurred will be invoiced.

4) Merchandise Returns:
No returns accepted without prior approval or issuance of returned good authorization number. A restocking fee will be charged if returned goods are a result of customer error. NO CLAIMS HONORED 30 DAYS BEYOND SHIPPING DATE.

5) F.O.B.:
Location: Orange City, IA or port of entry

6) Terms: Net 30 days F.O.B. shipping point, factory, with approved credit. Merchandise shipped C.O.D. upon approval only, and as option to open account terms. Visa, Mastercard and American Express credit cards are welcome. All returned checks are subject to a $50.00(a) handling charge and the account will be changed to C.O.D., cash or cashiers check. A late payment service charge of 1.5% per month is applied to any balance outstanding 30 days or more beyond payment due date.

9) Drop Shipments: $5.00(a) per destination.

10) 5% overrun or underrun considered fulfillment on all orders.

11) Guaranteed Delivery Charge:
$1.50(a) per parcel shipped. This charge covers lost merchandise, claims verified by UPS, and the balance of the shipment above that which is covered by UPS (including processing of such claims by The Legend Marketing Group). Does not guarantee shipping or arrival date.

12) Prices: Prices effective January 1, 2007.

13) Minimum/Multiple:
Minimum refers to minimum order quantity per color/style/ID. Any changes made to the cap will require new minimums. Multiple refers to increments required after meeting initial minimum quantity in the same color, style and ID.

14) Sample Policy:
Legend Marketing stocks a variety of random samples. Please call your representative for random or identified spec sample charges.

15) Emblems: All emblems sewn on at a charge of $.58(a) per cap. Emblems must not exceed 2.75" high by 5" long. Round emblems must not exceed 3" in diameter. Emblem orders considered complete with 5% overrun/underrun.
